Terms of Service

1. Acceptance of Terms

By accessing or using Cloud Hero AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Cloud Hero AI provides the following tools for cloud engineering teams:

• Hero Savings: AI-powered cloud cost optimization that connects to your cloud infrastructure (AWS, GCP, Azure) to identify and remediate wasted spend
• Hero Agents: No-code AI workflow automation builder
• Hero Copilot: AI assistant for infrastructure and DevOps tasks
• Hero Weekly: Newsletter and community for cloud engineers

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately at security@cloudheroai.com if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account.

4. AWS Credentials and Infrastructure Access

By providing your AWS credentials, you authorize Cloud Hero AI to access your AWS account using those credentials for the purpose of performing cost audits and, if you explicitly approve, applying remediation actions.

You represent that you have the authority to grant this access. You are solely responsible for the consequences of any changes made to your infrastructure through the Service.

We strongly recommend:

• Creating a dedicated IAM user with minimal required permissions
• Testing recommendations in a non-production environment first
• Reviewing each finding individually before applying bulk fixes
• Maintaining your own backups before any remediation

Cloud Hero AI is not liable for data loss, service outages, or any damages resulting from infrastructure changes made through the Service, even if those changes were recommended by our AI systems.

5. Acceptable Use

You agree not to:

• Use the Service to access cloud accounts you do not own or have explicit written authorization to access
• Attempt to reverse-engineer, decompile, or extract the source code of any part of the Service
• Use the Service to violate any applicable law or regulation
• Resell or sublicense access to the Service without our written permission
• Use automated scripts to abuse the API beyond reasonable usage limits
• Attempt to gain unauthorized access to our systems or other users' accounts

6. Subscription and Billing

Paid plans are billed in advance on a monthly or annual basis. All prices are in USD unless otherwise stated.

Free trial: Where offered, free trials convert to paid plans at the end of the trial period. We'll email you before any charge.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for unused time, except where required by law.

Refunds: If you are unsatisfied within 14 days of your first paid charge, contact us at support@cloudheroai.com for a full refund.

Price changes: We'll provide 30 days' notice before increasing prices for existing subscribers.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Cloud Hero AI and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your data, including your cloud infrastructure data and any content you upload. By using the Service, you grant us a limited license to process that data solely to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

AI-generated recommendations (savings findings, Copilot responses, audit summaries) are provided for informational purposes only. Always verify recommendations before taking action. We are not liable for decisions made based on AI outputs.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUD HERO AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or if we discontinue the Service. We will provide reasonable notice where possible.

Upon termination, your right to use the Service ends immediately. We will delete your data within 30 days of account closure, except where retention is required by law.

11. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Disputes shall be resolved by binding arbitration in San Francisco, CA, except you may bring claims in small claims court.
